Capital gains: Why Juventus and Paratici in trouble, but Napoli cleared

The FIGC confirmed its prosecutor has asked to revoke the verdict clearing Juventus and others of artificially inflating transfer fees for capital gains, but while Napoli can rest easy, Tottenham’s Fabio Paratici is in danger.

The Italian Football Federation has announced the appeal following the inspection of new evidence provided by the public prosecutor in Turin as part of the so-called Prisma investigation.

This includes confiscated documents and wiretapped telephone conversations.

The clubs – Juventus, Napoli, Chievo, Sampdoria, Pro Vercelli, Genoa, Parma, Pisa, Empoli, Novara, Pescara – were all cleared in April and that was confirmed in May on appeal.

That was because the magistrate ruled it was impossible to judge precisely how much a player is worth on the transfer market, other than what two clubs agree it to be.

It therefore could not be proved that anyone was artificially inflating the value.

That could now change because of the evidence showing Juventus directors discussing the capital gains – plusvalenze – in private conversations, acknowledging they knew full well the values were inflated.

This is why Tottenham Hotspur could also be in trouble, because many of those conversations pin-pointed former Juventus director Paratici in using this tactic often and recklessly.

However, Napoli and Chievo are safe because the FIGC is no appealing against the verdict clearing them of inflated capital gains.

They did not do deals with Juventus, so there is no new evidence to be considered.

It is a huge sigh of relief for Napoli, because the transfer of Victor Osimhen from LOSC in exchange for cash plus three youth players had rung real alarm bells.

Officially, Napoli had handed over Claudio Manzi, Ciro Palmieri and Luigi Liguori at a value of €20m, despite the fact they would never play in the top flight and were essentially dropped for free by LOSC a year later.

This exchange deal allowed LOSC to boost their capital gains and made Napoli look as if they were selling off youth products at a huge profit.

Juventus confident they can ‘demonstrate correctness’ in capital gains

Juventus have released a statement assuring they are confident that the potential reopening of the investigation into inflated capital gains will allow the club to ‘further demonstrate the correctness of its actions.’

The Bianconeri are one of nine clubs who were originally cleared of wrongdoing in April and then May, because it was ruled that it was impossible to accurately judge how much a player is worth other than the fee two clubs agree upon.

However, the FIGC prosecutor announced it is appealing to revoke that verdict based on new evidence received from the Turin public prosecutor’s investigation into Juventus, including confiscated documents and wiretapped telephone conversations.

Napoli and Chievo are exempt from the appeal, because the new evidence only relates to those clubs who did deals with Juventus, namely Sampdoria, Pro Vercelli, Genoa, Parma, Pisa, Empoli, Novara and Pescara.

A statement was released by Juventus this evening assuring they will welcome the new opportunity to present their case to the authorities and that their treatment of capital gains is perfectly legal.

“Juventus Football Club S.p.A. (“Juventus” or the “Company”) informs that tonight it has received, together with 8 other Italian football companies and respective senior managers at the time of the events, from the Federal Prosecutor’s Office before the F.I.G.C. (Federazione Italiana Giuoco Calcio), a “impugnazione per revocazione parziale, ex art. 63, del C.G.S., della decisione della Corte Federale di Appello, Sezioni Unite, n. 0089/CFA-2021-2022 del 27 maggio 2022, divenuta definitiva” (appeal by partial revocation, pursuant to Article 63, of the C.G.S., of the decision of the Federal Court of Appeals, United Sections, No. 0089/CFA-2021-2022 of May 27, 2022, which became definitive).

“Pursuant to the decision, the Federal Court of Appeals had rejected the appeal (“reclamo”) brought by the Federal Prosecutor’s Office against the decision of the National Federal Court, which, in turn, had acquitted Juventus and the other parties charged because of the lack of any disciplinary offence with regard to the evaluation of the effects of certain transfers of players’ rights on financial statements and the accounting of capital gains.

“The Company will articulate its defenses within the terms provided by the Code, trusting that it will be able to further demonstrate the correctness of its actions, the absence of new elements relevant to the judgment with respect to the decision of the Federal Court of Appeals, and the lack of the prerequisites of the proposed appeal.”

Atalanta will sell Juventus target for 15m euros

Atalanta is prepared to sell Joakim Maehle amidst interest from Juventus as the Bianconeri seek to make the Dane a member of their group in Turin.

Juve has had their eyes on him for some time now, and after watching him at the WC, they could move for him in January.

Atalanta had previously been against selling him and wanted a huge transfer fee before releasing him from Bergamo.

However, that seems to have changed with a report on Tuttomercatoweb revealing they will sell him for the right price even in January.

It claims La Dea will accept any offer of around 15m euros for his signature, making it easy for Juve to make their move or drop their interest.

Massimo Brambati reckons Juventus could be sold by Exor and the Agnelli family at the end of this season because it is the only asset losing money for its parent company.

Juve has been posting huge losses every season since 2019, and they were the Italian club rocked the most by the covid pandemic.

According to different reports, things had been so bad financially that the club had to use capital gains to save face, and it does not seem they will stop losing money soon.

Any club owner wants to profit from the ownership, so that could force Exor to sell, and Brambati suggests it could happen next year.

He said via Tuttojuve:

“I also had the news that the property can sell Juventus. It is Exor’s only loss-making asset. And I had this news like others, of a sale to a Qatari or American fund, which could materialize in summer 2023”.

Selling Juve will be the last thing on the minds of its owners, but we cannot completely rule it out, considering the many financial problems the club has had recently.

They will consider all the options on the table, and if selling up appeals the most, it will not be a surprise to see them put the club on the market.

Boost for Juventus as two of their targets head towards Real Madrid exit


Juventus has been handed a boost in their pursuit of a couple of Real Madrid players as the Spanish club prepares to bid farewell to them.

Juve loves to shop for free agents and has been searching for prospective ones around the continent this season.

One man they have their eyes on is Marco Asensio, who seems to be on his way out of Real Madrid, having failed to agree to a deal with the Spanish side.

Juve is hopeful they can win the race for his signature, and they are watching to see if he will extend his deal or enter pre-contract talks from next month.

A report on Tuttomercatoweb reveals the attacker is heading for an exit from the Madrid club, and he is not alone.

Juve’s other transfer target at the club, Dani Ceballos, is also set to leave as a free agent, with his contract not in line to be renewed by Los Blancos.

As per Calciomercatoweb, Juventus might sweeten a deal for Diogo Dalot by offering Adrien Rabiot to the Red Devils. The Portuguese defender has had a breakthrough season so far for Manchester United under the tutelage of Erik ten Hag.

Tottenham Hotspur are reportedly interested in signing the Juventus midfielder Adrien Rabiot during the January transfer window.

According to a report from Calciomercatoweb, Juventus are prepared to sell that 27-year-old for a cash offer but Tottenham are eyeing a part exchange deal. The player will be a free agent in the summer and the Italian giants have no option but to sell him next month.
